Rental Agreements 101: What Every Owner Should Know
Understand the legal clauses that protect your property and your income — before you sign anything.

A rental agreement is the single most important document in a landlord-tenant relationship — and also the most commonly rushed. Most disputes over deposits, notice periods, or property damage trace back to a vague or incomplete agreement.
Clauses you shouldn't skip
● Rent and escalation: State the exact monthly rent, due date, and any annual increase percentage (typically 5-10%) upfront.
● Security deposit terms: Specify the deposit amount, and — critically — the conditions under which deductions can be made (unpaid dues, damage beyond normal wear and tear).
● Lock-in period and notice period: Most agreements include a minimum lock-in (often 6-11 months) and a notice period (usually one to two months) for either party to exit.
● Maintenance responsibility: Clarify who pays for society maintenance charges, and who's responsible for repairs — the owner or the tenant — for different types of issues.
● Registration: In most states, agreements over 11 months must be registered to be legally enforceable. An unregistered agreement offers far weaker protection in a dispute.
● Exit and handover terms: Define what "normal wear and tear" means, and how the property's condition will be assessed at move-out.
A common mistake
Owners often use generic templates downloaded online, which may not reflect current state-specific rental laws or the specifics of their property. A generic clause on subletting or pet policies, for instance, can create ambiguity later.
